Asset Finance Solutions are committed to complying with the General Data Protection Regulation and the Data Protection Act 2018, we are Business Finance Brokers based in Wellington, Somerset.

We act as an Introducer/Broker for our customers.  Asset Finance Solutions are Authorised and Regulated by the Financial Conduct Authority No. 690013

Here at Asset Finance Solutions we take your privacy seriously and we want you to be confident that your personal data is kept safely and securely.

All telephone calls are recorded for training and monitoring purposes, we will store the recordings for three years on an encrypted server.

How do we use your information?

We will use your personal information in a number of ways, which helps us

  2. For fraud prevention

  5. Credit reference checks

We will share your information and obtain information about you with our panel of Lenders, Companies that you introduce to us, Land Agents, The Supplier of goods to you, Credit reference agencies and Fraud Prevention agencies.

We will not disclose your information to any company outside of Asset Finance Solutions, our panel of Lenders, Companies that you introduce to us, Land Agents, The Supplier of goods to you, Credit reference agencies and Fraud Prevention agencies.

In order to process your application our panel of lenders will supply your information to credit reference agencies to assess your creditworthiness and check your identity.

Asset Finance Solutions have to supply the lender with consent from all parties agreeing for a credit search to be undertaken, this will be verbal consent when you first make your enquiry followed by signed consent which will be relied upon and may form the basis of any contract between the applicant(s) and the chosen lender.

Asset Finance Solutions processes your personal data as a data controller in its own right, when a Lender, a Company that you introduce to us, Land Agent, a Supplier of Goods to you, Credit Reference Agencies and Fraud Prevention agencies hold your data you should ask them for a copy of their own privacy policy.

What we need

Asset Finance Solutions will be known as ‘The Controller and The Processor’ of the personal data you provide to us.  We collect personal data about you which may also include any special types of information or location based information.

We also gather

  • Full name
  • Address and if required previous addresses
  • Date of Birth
  • Contact numbers and e mail address
  • Financial status
  • If a Partnership then all Partners will be asked for this information or if a Ltd Company all Directors will need to provide us with this information.

Why we need it?

We need to know your personal data to provide you with an accurate recommendation for your personal circumstances.  We will not collect any Personal data from you we do not need in order to provide and oversee this service to you.

Data Protection says that we are allowed to use and share your personal data only where we have a proper reason to do so.  The law says we must have one or more of these reasons and these are:

The lawful basis for processing are set out in Article 6 of the GDPR. At least one of these must apply whenever you process personal data:

(a) Consent: the individual has given clear consent for you to process their personal data for a specific purpose.

(b) Contract: the processing is necessary for a contract you have with the individual, or because they have asked you to take specific steps before entering into a contract.

(c) Legal obligation: the processing is necessary for you to comply with the law (not including contractual obligations).

(d) Vital interests: the processing is necessary to protect someone’s life.

(e) Public task: the processing is necessary for you to perform a task in the public interest or for your official functions, and the task or function has a clear basis in law.

(f) Legitimate interests: the processing is necessary for your legitimate interests or the legitimate interests of a third party unless there is a good reason to protect the individual’s personal data which overrides those legitimate interests. (This cannot apply if you are a public authority processing data to perform your official tasks.)

Asset Finance Solutions hold your data on the basis of Contract, to supply goods or services.

The purpose of holding data is Legal Records and Customer Service.

What we do with it?

All the Personal data we use is controlled by Asset Finance Solutions in the UK, however, for the purposes of IT hosting and maintenance, this information is located on servers within the European Union.  No third parties have access to your personal data unless the law allows them to do so.  We have a Data Protection regime in place to oversee and secure processing of your personal data.

We will never pass your data onto third parties, we may occasionally send e-mails containing information which we think you may find interesting using the e-mail address which you have provided.

Your data is stored electronically on our database, which is based in the UK. We are committed to ensuring that your information is secure in order to prevent unauthorised access or disclosure, we have put in place suitable physical, electronic and managerial procedures to safeguard and secure the information we collect from you and online.  Hard copies are stored in secure premises in locked filing cabinets.

How long do we keep it?

Asset Finance Solutions will hold your data for seven years after purchase or contract end date, after which time it will be destroyed.

Your personal data will be removed from our database immediately if you do not proceed with a contract.

What are your rights?

You are entitled to request the following from Asset Finance Solutions, these are called your Data Subject Rights and there is more information on these on the Information Commissioners website:  www.ico.org.uk

  • Right of access –to request access to your personal information and information about how we process it.
  • Right to rectification –to have your personal information corrected if it is inaccurate and to have incomplete personal information completed.

  • Right to restriction of processing – to restrict processing of your personal information
  • Right to data portability – to electronically move, copy or transfer your personal information in a standard form.
  • Right to object – to object to processing of your personal information.
  • Rights with regards to automated individual decision making, including profiling –rights relating to automated decision making, including profiling.

If you wish to raise a complaint on how we have handled your personal data, you can contact our Data Controller who will investigate the matter.

Where relevant, you have the right to withdraw consent at any time and this means that we cannot process your data provided without your consent.

If you are not satisfied with our response or believe, we are processing your personal data not in accordance with the law you can complain to the Information Commissioner’s Office (ICO). Their address can be found at the bottom of this page.
